Growth Hacker Consulting Private Limited (referred to as “we,” “us,” or “ConsultEasy”) operates the ConsultEasy platform, which includes the website www.consulteasy.info and associated services (“Services”). These Terms and Conditions (“Terms”) govern your access and use of the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Services.

1. NATURE AND APPLICABILITY OF TERMS

These Terms and the Privacy Policy (available at Privacy Policy Link) together constitute a legal agreement (“Agreement”) between you and ConsultEasy. This Agreement applies to:

• Practitioners: Medical professionals, healthcare providers, or organizations listed on the platform.
• End-Users: Patients or their representatives seeking services through the platform.
• Other Users: Any visitor to the platform.

By using the Services, you accept the conditions stipulated in these Terms. We reserve the right to modify or terminate any portion of this Agreement at any time. Continued use of the Services after modifications implies your acceptance of the revised Terms.

2. COMPLIANCE WITH LAWS

This Agreement is governed by Indian law, including but not limited to:

• The Indian Contract Act, 1872;
• The Information Technology Act, 2000, and its associated rules;
• Other relevant regulations and guidelines.

3. CONDITIONS OF USE

You must be at least 18 years of age to register and use the Services. By using the Services, you represent that you have the authority and capacity to abide by these Terms.

4. END-USER ACCOUNT AND DATA PRIVACY

4.1 Account Responsibilities: You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access.

4.2 Data Collection: We collect and use your data as outlined in our Privacy Policy. This includes personal, medical, and technical information to enhance your experience and ensure compliance with legal requirements.

4.3 Data Accuracy: Users are responsible for providing accurate and current information. Failure to do so may result in suspension or termination of your account.

5. SERVICES OFFERED

5.1 For Practitioners:

• Listing of profiles and contact details.
• Facilitation of appointments with patients.

5.2 For End-Users:

• Search and book appointments with Practitioners.
• Access health records and other relevant information.

5.3 Service Modifications: Services may evolve over time, and these Terms will apply to all current and future services.

6. SHARING AND DISCLOSURE

We may share information with:

• Practitioners for consultations.
• Service providers for payment processing and analytics.
• Government authorities, as required by law.
• Aggregated, anonymized data for research or business purposes.

We do not sell or rent your personal data to third parties.

7. SECURITY MEASURES

We implement industry-standard measures to secure your data, including encryption and firewalls. However, no system is completely secure, and we encourage users to exercise caution when sharing sensitive information.

8. USER RIGHTS

You have the right to:

• Access and correct your personal data.
• Request deletion of your data, subject to legal retention requirements.
• Opt-out of marketing communications.

9. LIMITATION OF LIABILITY

We are not liable for:

• Any medical outcomes resulting from consultations.

Our total liability is limited to INR 1,000.

10. TERMINATION

We reserve the right to suspend or terminate your access to the Services for violations of these Terms or applicable laws.

11. INTELLECTUAL PROPERTY

All content on the platform, including text, graphics, and logos, is the property of ConsultEasy. Unauthorized use or reproduction is prohibited.

12. THIRD-PARTY LINKS

The platform may include links to third-party websites. We are not responsible for the content or practices of these external sites.

13. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by the laws of India. Any disputes will be resolved through arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996. The courts in Bengaluru will have exclusive jurisdiction.

14. CHANGES TO TERMS

We may update these Terms periodically. Users will be notified of significant changes via email or platform notifications.
